本书从历史和政治的视角，对中国—东盟刑事、民商事司法合作进程进行研究；通过将中国与东盟司法合作发展进程划分萌芽期（1991—1996）、成长期（1997—2002）、提升期（2003—2014）三个阶段，对不同政治互信背景下开展司法合作的疏密程度进行分析，揭示中国与东盟司法合作制约因素；借鉴欧盟、东盟区域司法合作经验，从功能主义理论的视角提出在相当长的时期中国—东盟司法合作法律框架需要从纵向的中国与东盟（10+1）、大湄公河次区域、中国与东盟国家间三个层次，横向的第一轨道官方外交、第二轨道半官方智库外交和第三轨道民间交流来共同构建，而且第二轨道和第三轨道应发挥更大作用。

This book studies the process of China-ASEAN criminal and civil and commercial judicial cooperation from the perspective of history and politics. By dividing the development process of judicial cooperation between China and ASEAN into three stages: embryonic period (1991-1996), growth period (1997-2002), and upgrading period (2003-2014), the degree of sparseness of judicial cooperation under different political mutual trust backgrounds is analyzed, and the constraints of judicial cooperation between China and ASEAN are revealed. Drawing on the experience of judicial cooperation between the EU and ASEAN regions, from the perspective of functionalist theory, it is proposed that for a long time, the legal framework for China-ASEAN judicial cooperation needs to be jointly constructed from the vertical three levels of China-ASEAN (10+1), Greater Mekong Subregion, and China and ASEAN countries, horizontal official diplomacy on the first track, semi-official think tank diplomacy on the second track and people-to-people exchange on the third track, and the second track and the third track should play a greater role.（AI翻译）
